1. The Service - A Referral Service

The Site is a referral and call-connection service. When you call the number on the Site or submit a request, you are connected to an independent, third-party roofing professional serving the Seattle area (a "Service Professional"). The Operator does not perform roofing repair, installation, or any other home services, does not employ the Service Professionals, and is not a contractor.

2. Independent Service Professionals

Service Professionals are independent businesses. All quotes, pricing, scheduling, workmanship, warranties, permits, and services are provided solely by the Service Professional, under their own name and their own Washington State contractor registration. Any agreement for services is between you and the Service Professional only. You are encouraged to request the professional's contractor registration number and verify it with Washington State Labor & Industries before hiring.

3. Call Recording and Information Sharing

Calls to the number on the Site are recorded, and a notice is played at the start of each call. Your call, phone number, form details, and the information you share are provided to the connected Service Professional so they can assist you. See our Privacy Policy for details.

4. No Charge to Callers; Compensation Disclosure

Calling the number on the Site, submitting a request, and receiving quotes are free of charge to you. The Operator may be compensated in connection with connecting calls and requests to Service Professionals. This compensation does not affect the price you pay the Service Professional.

5. Consent to Be Contacted

By calling the number on the Site or submitting your contact details, you request a connection to a Service Professional and consent to being contacted about your request by the Service Professional - and, where needed to facilitate the connection, by the Operator - by phone call or text message at the number you provided, including by calls that are recorded as described above. Message and data rates may apply. This consent relates to your service request and is not a condition of purchasing anything; you may tell the Service Professional to stop contacting you at any time.

6. Offers and Promotions

Discounts or promotions referenced on the Site (such as percentage-off repair offers) are provided and honored by the Service Professional, are subject to the scope and type of work, may carry conditions, and may be changed or withdrawn at any time. Confirm the details of any offer directly with the Service Professional before work begins.

7. No Warranty for Services

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND THE CALL-CONNECTION SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE." THE OPERATOR MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE, THE AVAILABILITY OF SERVICE PROFESSIONALS, OR THE QUALITY, SAFETY, LEGALITY, TIMELINESS, PRICING, OR RESULTS OF ANY WORK PERFORMED BY A SERVICE PROFESSIONAL. THE OPERATOR DOES NOT ENDORSE OR GUARANTEE ANY SERVICE PROFESSIONAL, AND IS NOT RESPONSIBLE FOR THEIR ACTS OR OMISSIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY DAMAGES ARISING FROM SERVICES PERFORMED BY A SERVICE PROFESSIONAL. THE OPERATOR'S TOTAL AGGREGATE LIABILITY ARISING FROM THE SITE OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PORTIONS OF THIS SECTION MAY NOT APPLY TO YOU.

9. Acceptable Use

• Do not use the Site or the phone line for unlawful, fraudulent, abusive, or harassing purposes;
• Do not place automated, spam, or solicitation calls to the number on the Site;
• Do not scrape, copy, or republish Site content without permission; and
• Do not interfere with the operation or security of the Site or the call-connection system.

10. Intellectual Property

The Site and its content are owned by the Operator or its licensors and are protected by applicable intellectual-property laws. You may use the Site for personal, non-commercial purposes only.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold the Operator harmless from claims arising out of your misuse of the Site, your violation of these Terms, or your violation of applicable law.

12. Dispute Resolution; Binding Arbitration; Class Action Waiver

Informal resolution first. Before filing any claim, you agree to contact us at contact@seattlelocalroofing.com with a description of the dispute and give us sixty (60) days to work with you to resolve it informally.

Binding arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to the Site, the Service, or these Terms that is not resolved informally shall be resolved by final and binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration may be conducted by telephone, by video conference, or based on written submissions, or in person in the county where you live. The arbitrator has exclusive authority to resolve any dispute about the interpretation, applicability, or enforceability of this agreement to arbitrate, and judgment on the award may be entered in any court of competent jurisdiction.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive or other equitable relief in court for infringement or misuse of intellectual property.

CLASS ACTION AND JURY WAIVER. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. BY AGREEING TO THESE TERMS, YOU AND THE OPERATOR EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

Opt-out. You may opt out of this arbitration agreement within thirty (30) days of first using the Site by emailing contact@seattlelocalroofing.com with the subject "Arbitration Opt-Out" and your name and phone number. Opting out of arbitration does not affect any other provision of these Terms.

If the class action waiver is found unenforceable as to a particular claim, then that claim (and only that claim) shall proceed in court, and the waiver shall remain enforceable as to all other claims.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Subject to Section 12, any court proceeding arising out of these Terms or the Site will be brought in the state or federal courts with jurisdiction over Clark County, Nevada, except where applicable law requires otherwise.

14. General

These Terms, together with the Privacy Policy, are the entire agreement between you and the Operator regarding the Site. If any provision is found unenforceable, the remaining provisions remain in full force. The Operator's failure to enforce any provision is not a waiver of it. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them. Except for Service Professionals' rights under Sections 2 and 5, there are no third-party beneficiaries to these Terms. Sections that by their nature should survive termination (including Sections 7, 8, 11, 12, and 13) survive.

15. Changes to These Terms

We may update these Terms from time to time. Updated Terms take effect when posted, and the "Last Updated" date will be revised accordingly. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
